EASTHAM CONSERVATION COMMISSION
14 February 2006


MINUTES
             

PRESENT:        Stephen Smith, David Hoerle, Glenn Collins, Judith Williams.

STAFF PRESENT:  Deputy Natural Resourses Officer Katelyn Merrill

ALSO PRESENT:   J.A. Mouchantat, Ken Kopley,Elizabeth Anderson, Stephen Phifer, Fred Ambrose, John Schnaible of Coastal Engineering Company, Inc.

Chairman Glenn Collins called the meeting to order at 7:00 P.M.
                        
Approval of Minutes of 24 January 2006.  Mr. Collins pointed out that in regard to the DePaulo COC,  the stairs at the site were not on the approved plan and that should be included in the Minutes.  Minutes approved.

7:15 P.M.       Notice of Intent filed by Frederick & Michelle Mensel, Thomas & Maureen Lapham, and Katherine Mouchantat at  425 Shurtleff Road, Map 07, Parcel 144, 435 Shurtleff Road, Map 07, Parcel 142A, and 405 Shurtleff Road, Map 07, Parcel 145, respectively.

The applicants  requested a continance until March 14th.  The Commission MOVED and SECONDED the request for the continuation.

SO VOTED UNANIMOUSLY.

7:20 P.M.       Request for Certificate of Compliance, Stafford DEP SE 19-1016, 410 State Highway, Map 21, Parcel 081B.

Deputy Merrill provided the paperwork for the Certificate of Compliance.  Chairman Collins made a site visit to the pier today and was pleased to note that it was all constructed with non-treated wood.  Mr. Collins said he thinks that this might be a standard for this Commission.

Mr. Hoerle MOVED to issue the Certificate of Compliance. Mr. Smith SECONDED the motion.

SO VOTED UNANIMOUSLY.







7:30 P.M.       Request for Change in Plans, David Palten DEP SE 19-1128, 3 Bayberry Drive, Map 13, Parcel 144.

The revetment repair plan will include the addition of two rows of Twenty Inch (20") fibre rolls.

Mr. Hoerle MOVED  to accept the change in plans. Mr. Smith SECONDED the motion.
 
SO VOTED UNANIMOUSLY.

7:45 P.M.       Extension Request, Linda Novak DEP SE 19-1100, 95 Bay View Drive, Map 10,
                Parcel 277.  

The applicant requested to continue to nourish the coastal beach.  Mr. Hoerle MOVED to approved the three-year Extension.  Mr. Smith SECONDED the Motion.

SO VOTED UNANIMOUSLY.

7:50 P.M.       Administrative Reviews

Deputy Merrill reviewed the following Administrative Reviews:

17 Nycoma Way - Prifty - Installation of a well and septic system inside the 100' Buffer Zone.  Mr. Collins expressed concern that this situation might require the review of the Commission if there are problems involved in the installation of the well.  It was agreed that the applicant would have to come back to the Commission if there are any changes.  The application was unanimously ratified.

285 Corliss Way - Wunderlich - Installation of a well within 50' from the Top of the Coastal Bank.  The application was unanimously ratified.

100 Dyer Prince - Ken Kopley - Installation of a septic system with the piping from the system to the Distribution Box inside of the Buffer Zone.  The application was unanimously ratified.

25 Great Pond Road - Riley - Removal of seven (7) trees blown over by the December 9th storm within the Buffer Zone.  The application was unanimously ratified.

25 Turnip Field Road - St Aubin - Septic tank and pump chamber and piping to be installed within the Buffer Zone; cesspools to be pumped and filled.  The application was unanimously ratified.


8:00 P.M.       Notice of Intent filed by Christopher and Bette Ann Anderson, 20 Teal Way, May 17, Parcel 505.   

Applicants propose construction of a single-family dwelling with deck, garage, driveway, subsurface sewage disposal system, and associated grading on vacant land at property located at 20 Teal Way, May 17, Parcel 505.  John Schnaible of Coastal Engineering was representing the Andersons.  

Ms Merrill noted that there is a gentle slope in the areas going toward the resource.  She also noted that the neighboring house has done some cutting along the property line into this property.    She noted that the location of the house is out of the Fifty (50) foot Buffer Zone, and that moving the house or garage farther away may not be of benefit to the resource area which is a Flood Zone.  Dry wells on either side of the house will absorb the runoff.  Ms. Merrill recommended a landscaping plan approved by the Commission before building commences.

Mr Fred Ambrose, project manager for this project, spoke for the present plan.  They are willing to work with a landscape plan to replace whatever is removed during construction.  Ms Merrill again stressed that there has been an effort here to keep all building out of the Fifty (50) foot Buffer Zone.
                                                
Mr. Ambrose pointed out that this is a sensitive design, with a sense of balance with the environment.  Ms. Williams objected to the proximity of the house to the resource.  Mr. Collins agreed that the house should be relocated so that it would not be in the Fifty (50) foot Buffer zone as this has been the Commission’s policy.  He also noted that there should be no grading on this lot, especially since the grading would be sloped toward the marsh.

Mr. Smith suggested moving the building Five and One Half Feet (5 ½’) back from the Buffer Zone and to not dig a complete basement.  Mr. Hoerle suggested that the Commission be polled as to their expectation on this property.

Chairman Collins said that all the Commissioners would be interested in having the building itself moved farther back and the grading limited.  The discussion led to the Project Manager offering to return to the Commission with a compromise plan.  Mr. Collins also advised that the Limit of Work would have to be brought in for the final plan.  The Applicants will return on March 28th with a revised plan.

Mr. Hoerle MOVED for a continuance. Mr Smith SECONDED the Motion.

SO VOTED UNANIMOUSLY.

8:15 P.M.       Notice of Intent filed by Thomas Abramcyzk, 75 Shurtleff Road,  Map 10,
Parcel 235.    

Applicant proposes construction of a stone revetment at property located at 75 Shurtleff Road, Map 10, Parcel 235.  This application is for a One Hundred Foot (100') rock revetment on a property which has sand bag installations on both abutting properties.  Annual and compensatory nourishment is proposed.  Tim Brady of East Cape Engineering, Inc.  presented the applicant’s proosal.  Mr. Hoerle noted that although there is a reluctance to see yet another rock revetment built on the Bay, the Conservation Commission should try to be consistent and allow here what has been allowed at other properties.  

Mr. Hoerle MOVED Orders of Conditions 1-18, 19, 21, 22, 23, 28, 33, 35, 37, 37, 41, 42 (a gauge placed at the top to mark erosion and the need for renourishment).  Also, refer to the Hatch Order of Conditions to clarify special conditions.  Mr. Smith SECONDED the Motion.

8:30 P.M.       Notice of Intent filed by John and Carol Keaveney, 245 Sparrow Road, Map 04, Parcel 187.  

Applicants propose maintenance of an existing stone revetment, nourishment, and stabilization of the slope at the top of revetment.  Mr. Brady also represented these Applicants.  The applicants would like to continue to maintain their revetment and stabilize the Coastal Bank with plantings.  Mr. Hoerle asked whether the applicants plan to use fiber rolls as well, and Mr. Brady sketched some into the plan for reference.  

Mr. Smith MOVED that the Order of Conditions be replicated from the orders given for the Abramcyck application.  Mr. Hoerle SECONDED the Motion.

SO VOTED UNANIMOUSLY.

8:45 P.M.       Notice of Intent filed by the Town of Eastham, portion of Herringbrook Road,
Map 14.  

Applicant proposes repair and maintenance of a portion of Herringbrook Road.  The Commission MOVED and SECONDED the request for a continuation.

SO VOTED UNANIMOUSLY.

The meeting was adjourned at 9:28 P.M.
